These terms and conditions apply to your use of this website, including any orders that you place on www.greenweez.co.uk. Please read these terms carefully before using this website. Using this website indicates that you fully accept these terms regardless of whether or not you choose to register with us. If you do not accept these terms, do not use this website.

These terms and conditions do not affect your statutory rights.

All rights in this website are owned by us. Any unauthorized use, copying or modification is prohibited.

2. Ordering goods

2.1 All orders placed through our website will be subject to our acceptance of the order.

2.2 When you submit an order to us on our website you will receive a confirmatory email of this order saying that we are processing your order. You will then receive a second email from us acknowledging your order and giving you estimated timescales for delivery. You should check both emails for accuracy and let us know immediately if there are any errors. Neither of these emails constitute acceptance of the order by us. Your order will be accepted by us (and a contract will then be formed between us) when we dispatch the goods to you. Title to the goods will pass to you on delivery.

2.3 We take payment from your card when we process your order and have checked your card details. Products are subject to availability. If we are unable to supply the products, we will inform you of this as soon as possible.

2.4 Unless we have notified you that we do not accept your order or you have cancelled it, order acceptance and the creation of the contract between you and us will take place at the point the products you have ordered are dispatched from our warehouse to be delivered to the address you have given us. It does not take place until that stage, even though we may have debited your card (see 2.3 above) or we have sent acknowledging emails (see 2.2 above).
Very occasionally an error may occur resulting in the products described on our website not being the products actually available for sale. If this occurs your order will not be or have been accepted. We may ask you whether you wish to purchase other products we may have available or the products which may have been dispatched to you in error. If so your order will be amended.

2.5 Should you wish to cancel your order or return any goods, please go to the Returns section for further information.

3. Vouchers and Promotional codes

3.1 Promotional codes are codes that enable customers to obtain benefits such as discounts, free delivery and free gifts. These codes are non-transferable so may only be used by the person to whom they are issued and must only be used in accordance with their terms and conditions of use. If you use a promotional code to claim a promotional benefit, you must first check that it was issued to you and that you are eligible to use it.

3.2 By using it to claim a promotional benefit you will be confirming that you are entitled to use the code, you meet all the conditions that apply to its use and you finally agree to the terms set out below.

If, before accepting your order, we find that you are not entitled to use the code or do not meet all the terms and conditions of its use, we may reject your order or alternatively process it without the promotional benefit being applied. If, after accepting your order, we find that you were not entitled to use the code or did not meet all the terms and conditions of its use, we may reverse the benefit that you obtained.

4. Product information

Please note that some products' instruction manuals do not come in English. If the instruction manual does not come in English, this information will be clearly featured in the description of the specific product.

Some products come with 2-pin plugs. Adapters from European to UK plugs will be supplied with your order.

5. Pricing

5.1. All prices are inclusive of VAT where appropriate. The VAT inclusive amount is included in the total price published on the site. We reserve the right to raise our prices in line with any increase in the prevailing rate of VAT. This will be shown clearly on your order.

5.2 Delivery charges are clearly shown and invoiced at the end of the order in addition to the price of the products. We reserve the right to modify our prices at any moment but this will be indicated to you on the order at the time the order is placed. For further information on delivery charges, see the Delivery section.

5.3 All prices are subject to change without prior notice. Greenweez.co.uk reserves the right to change its prices at any time but products are invoiced at the price applicable when the order is registered.

5.4 Offers cannot be used in conjunction with any other offer, promotion or discount.

5.4 We do our best to make sure that prices are correctly shown but very occasionally an error may occur. We will not accept an order if there is a pricing error.

6. Payment

6.1 Payment methods

Payment may be made by the methods indicated on our website. We accept immediate payment using credit or debit card: Visa, Mastercard and Maestro. You can also pay your order by PayPal, using your PayPal account.

Payment is due upon order placement. If you would like to pay by bank transfer, we are happy to accept payment this way. Please note that orders will not be dispatched until the payment has been cleared. This can sometimes take several days, that is why we recommend you to make payments by credit card.

6.2 Data protection

All confidential banking data that you communicate for the purpose of product payment is managed directly by our financial partner via its encrypted site. Confidential data is encrypted and sent directly to the bank server without passing through the Greenweez server. We have no visibility nor access to this confidential data.

6.3 Payment verification

In certain circumstances, we reserve the right to request additional documentation to confirm the payment of your order. If you do not provide the requested documents, or refuse to do so, Greenweez also reserves the right to cancel your order in case of reasonable doubt as to its authenticity and reliability.

If we believe that you paid or are attempting to pay with fraudulent funds, using stolen credit card numbers and information, we also reserve the right to report the authorities information about fraudulent payments.

6.4 VAT

Prices include the Value Added Tax (VAT) applicable in the UK on the day of the order. All additional taxes connected to the sale and/or delivery of the order (in particular all customs duties) are the sole responsibility of the buyer.

6.5 Default of payment

In certain circumstances, we reserve the right to refuse to honour an order placed by a consumer that has not totally or partially paid a preceding order or with whom a payment dispute is being handled.

In case your payment has been refused by your bank (payment rejected, over limit on your credit card), you are required to make another payment within 7 calendar days. You may then be subject to late payment penalties with a 10% interest rate calculated on the total amount of your order from the date your payment was rejected.

In case a collection action is required by Greenweez, all costs incurred will be charged back to you, including unpaid fees and charges, bailiffs' charges or judicial expenses.

7. Delivery

7.1 Shipping charges

Orders will be delivered to the address indicated on the registration form that you complete during the order process. It is your responsibility to ensure the delivery address is ready and able to accept delivery of the product, in particular that there is space for any delivery vehicle to make the delivery.

Some postal addresses in Northern Ireland, some offshore islands and some remote areas of Great Britain may not be covered by our delivery services and we may not be able to arrange delivery of some items to such addresses. You will be notified of this when you place your order.

A delivery date is specified when placing the order, before confirming the order. The delivery date depends on the availability of the products (which may vary for each product) as well as the delivery method.

Shipping charges depend on the delivery method, the destination and the weight of the package. You will find all available mainland UK delivery rates (covering Northern Ireland, England, Wales and Scotland) on the Delivery page.

There is also the possibility of splitting the deliveries.

7.2 Delivery delay

In accordance with the 13th June 2014 Directive on Customer Rights, in the event of late delivery, we must deliver the goods within a reasonable time from the first day of delay relative to the delivery deadline that is announced when placing your order.

In that case, you can inform us by post or by email to customersupport@greenweez.com. If this period is exceeded, you may notify us with a new email or postal mail of your decision to withdraw from the contract.

The termination of the contract shall be performed within sixty working days starting from the delivery deadline.

The contract will be canceled upon receipt of the second email or postal mail, stating the order cancellation, if the delivery is not made between the sending and the reception of the email.

The sale cancellation, under the terms described in this section, requires the reimbursement of the order within a maximum period of fourteen days following the date of the contract termination. Greenweez's liability cannot be triggered if the failure or improper performance of the contract is attributable to the customer, to a third party or the case of a major force.

7.3 Signed and tracked Home delivery

When choosing the delivery method, the customer must choose the signed and tracked standard home delivery method.

Delivery by carrier:

This delivery method is made to the delivery address indicated by the customer while placing the order. A signature is needed on delivery.

The signature of the person accepting delivery at the delivery address will be proof that delivery has been received by you or the person to whom the order is addressed. If no one is available to accept the delivery, you will receive a delivery note to advise that a delivery has been attempted. Then you will have to contact our carrier to arrange an appointment by phone. If the recipient does not respond to the first delivery note, the carrier will attempt to deliver three times before returning the parcel to the sorting centre.

You should carefully check the products upon delivery to ensure that they are complete, in satisfactory condition and in accordance with their description before signing the delivery slip (paper or electronic). You have to refuse all damaged products by noting on the delivery slip "Refusal for Damaged goods". However, in case the delivery driver refuses to let you open the package, you have up to 72 hours to notify us about this damage or loss as soon as possible after receipt of your order: by email to customersupport@greenweez.com, indicating your order number and describing precisely the condition of the package and the damaged products.
If we do not receive your claims form by post or email, no refund nor replacement for items that have been damaged or lost in transit will be issued.

7.4 Error in the delivery address when placing the order

If you have made a mistake in the indication of your delivery address when placing your order, you may contact Greenweez Customer support to try to correct the error by using the contact form on the website - available here - and choosing "An address change" in the subject field.

Any application that is not done through this form using the methods described above will not be taken into account. If the customer request is made less than 2 working days before the dispatch date of the order, Greenweez will not be held responsible for not correcting the error in the delivery address.

When one or several errors in the indication of the delivery address are committed by the customer and when the goods were not able to be delivered for that reason, the customer has to re-pay postal charges so that the package is re-forwarded to him.

Furthermore, in case of an error in the delivery address indicated by the customer, shipping charges will not be refunded.

7.5 Greenweez reserves the right to refuse orders that weigh more than 30 kilos.

7.6 If an item is faulty, please contact us and we will arrange an appropriate remedy.

8. Product availability

All orders will be subject to the condition of the actual availability of the ordered products which the customer hereby accepts herein.

We will notify you as soon as any ordered product is unavailable. In accordance with the Sales of Good Act, Greenweez may in this case provide an equivalent quality and price product to the customer. The expenses of return relative to such a replacement, in the event of implementation by the customer of the right of withdrawal, as explained in the article 10 below, will be charged to Greenweez.

If the seller cannot provide the customer with any replacement good, the customer will be refunded within thirty days of payment without being eligible for any additional compensation of any kind.

9. Receipt of the order

As a seller, we will notify you of the existence of a legal guarantee of conformity for goods.

Upon delivery of your order, you will have to immediately check if the products correspond to the ones you have ordered and if they are in good conditions (damaged or faulty items).

If products are delivered damaged or missing, you must inform our Customer Support team in the next 72 hours by sending a letter describing the incident to "Greenweez, Customer Support, 301 Rue des Marais, 74410 Saint Jorioz, France" or via email to customersupport@greenweez.com.
It is also recommended in all cases to send an email to Greenweez Customer Support (customersupport@greenweez.com) indicating your order number and describing precisely the condition of the package and the damaged products.

You will then have to comply with the following procedure:
- Return all non-compliant products with acknowledgement receipt to Entrepôt Deret on behalf of Greenweez, 645 rue des châtaigniers, Bâtiment E-porte 24, 45770 Saran, France. If we can confirm the non-compliance of the products, the return postage charges will be our responsibility. Greenweez can provide in some cases a return label for the customer not to pay for return postage charges.
- Forward the invoice in the package of the returned good(s), or in case of a gift issued without an invoice, the delivery receipt of the product(s), as well as the return form that has been previously completed online.

If the non-compliance or missing part is actually established, the customer will be sent a new shipment of conforming goods. If any conforming good is available, the customer will be refunded the total amount of the order, including shipping charges.

For your return to be approved, you must imperatively return goods to us in their original packaging, with all their accessories and instructions.

10. Returns of faulty products (excluding damaged products during delivery)

All faulty products can be returned for exchange under the conditions described below.

To be approved, the return request must:
- Be processed after contacting Greenweez After-Sales service who has previously indicated to the customer a return address for the faulty or defective products.
- Be sent as soon as the defect has been noticed, by registered letter with acknowledgment of receipt to the address indicated by Greenweez Customer Support under the contact as described above. If the customer is a professional, the letter must be sent no later than the 15th day after delivery. Collect consignments freight will not be accepted.
- Be accompanied by the invoice of the returned product(s), or in case of an issued gift without an invoice, the delivery receipt of the product(s), as well as the return form that has previously been completed online.

If the default subject of the claim, after verification by its technical services and whether the warranty applies, is duly approved by Greenweez, the return postage costs will be charged in accordance with the law. If the default subject of the claim is not approved by us, or if the warranty does not apply, the return costs will be charged to the customer.

For your return to be approved, you must imperatively return goods to us in their original packaging, with all their accessories and instructions. When returning an unserviceable product, Greenweez will indemnify the customer on the basis of the initial value minus a predetermined of 1% obsolescence per month from the date of purchase.

If applicable, Greenweez will comply with its legal obligations on legal guarantees on hidden defects.

11. Right of Withdrawal

11.1 Conditions of the Rights of Withdrawal

This article is exclusively for customers deemed to be "consumers" within the meaning of the provisions of the Consumer Code - excluding, correspondingly, any informed professional.

In accordance with the Directive on Consumer Rights of 13th June 2014 regarding the consumer, in case of the withdrawal of the consumer, the seller must refund the shipping charges. The seller is not required to reimburse additional costs if the consumer has chosen a delivery method more expansive than the standard delivery method offered by the seller.

In case of withdrawal, the consumer will bear the cost of returning the goods. If the parcel weighs more than 30 kilos, the return cost may vary depending on the chosen carrier.

If, for any reason, you wish to do so, you have the right to cancel any order you have placed. Once your order has been delivered to you, you may notify us of your will to cancel the order up to 14 working days.

You must exercise his right of withdrawal in writing via the withdrawal form (go to "My Account" > "Order Tracking" > "Return an item"). After approval by our Customer Service we will confirm the receipt of your withdrawal request by email.
In case of an order of several products, the withdrawal period will be effective from the receipt of the last product.

In the 14 days after the transmission of the customer's will to withdraw, the products must be returned with all the original elements (packaging, accessories, notice), accompanied by the invoice and the return form that has previously been completed online.

In the case where the products have already been used, you agree to clean any usage tracks.

Since those products have been unsealed, the consumer's right to withdrawal disappears altogether in the case of audio and video recordings (especially all CDs or DVDs), perishable goods, alcoholic beverages, as well as underwear, swimwear and beauty products for hygienic reasons.

The consumer's liability shall be incurred in the event of impairment of property resulting from the handling other than those necessary to establish the nature, characteristics and functioning of such property, provided that the seller has informed the consumer of his right of withdrawal.

Any incomplete or damaged good will not be refunded or exchanged. Return costs are the exclusive responsibility of the customer.
Upon exercise of the right of withdrawal by the customer, Greenweez has 14 days to refund your order. Please note that we might defer the refund until receiving the goods or the proof that the products have been returned to us.

The refund will be made either by re-crediting the credit card used for the original order or by sending a voucher if this is the costumer's wish. The refund will incur no additional costs.

Subject to the conditions mentioned above, the returned products will be collected directly at your place or sent by registered letter with acknowledgment of receipt to Entrepôt Deret on behalf of Greenweez, 645 rue des châtaigniers, Bâtiment E-porte 24, 45770 Saran, France, accompanied by the invoice and the return form.

11.2 Returns outside the conditions of withdrawal

In case one of the conditions of the right of withdrawal described in 11.1 is not respected (incomplete product, damaged, missing notice or accessory, period of the right of withdrawal and return not respected...), the product will not be exchanged nor refunded.

Greenweez can return the product to the customer against payment of the delivery amount that will be indicated to the customer by Greenweez Customer Support team.

If the customer refuses to pay the necessary fees:
After a period of two months following the first Customer service notification on the amount to pay in order to receive the product, the customer will see the order delivered only after having paid the correct delivery and storage fees equal to (number of storage months after the two moths delay) multiplied by 0.08 of the VAT product value.

12. ROT clause (Retention of Tital)

The products sold are subject to ROT.

Accordingly, the seller retains ownership of the products until full payment and receipt of the price, as well as fees, taxes and other applicable fees (including all custom duties).
From the date of delivery, this clause does not prevent the transfer of the products’ risk to the customer.

Until full payment of the price (and accessories), the customer cannot transform, sell or pledge the product, under penalty of immediate claim. The costs and risks of the products return are the sole responsibility of the customer.

13. Liability

Greenweez will not be held responsible of the sale's breach in the case of a major force event or in the event of an unpredictable disruption or strike for even partial distribution services, including postal and/or transportation or communication.

Greenweez is not responsible of any damages that may arise from the purchase and/or use of the products.

The total or partial inability to use the products, mainly due to hardware incompatibility can not engage the responsibility of Greenweez nor give rise to any compensation or reimbursement.

The dealer's responsibility to the contract and transport risks:
In the case of a B2C e-commerce delivery, Greenweez bears the risk until the product is delivered to the customer.
In the case of the online professional sales (B2B), the risk transfer will occur as soon as the product is in the hands of the carrier.

14. Invalidity of a clause

If one or more of the provisions of these conditions is held to be invalid, void or for any reason unenforceable (following the application of a law or regulation or judgment of a competent court), it will not, however, affect the validity and enforceability of the remaining.

15. Severance

The parties agree that in the event of one or more clauses or sub-clauses of this contract being subsequently declared invalid or unenforceable by a court or other authority with jurisdiction, the invalidity or unenforceability of any clause or sub-clause shall not in any way affect the validity or enforceability of any other clause or sub-clause except those which compromise an integral part of it or are otherwise clearly inseparable.

16. Applicable law

Any dispute relating to the conclusion, interpretation, performance or breach of a sale between the parties and, more generally, any dispute arising in connection with such sale shall be within the exclusive jurisdiction of any court authorized by law to sort a dispute in connection with such sale. However, in the case of a professional buyer, any dispute arising in connection with such sale shall be the exclusive jurisdiction of the courts of Annecy.

18.1 We reserve the right to make changes to these terms and conditions in the future. Any changes will be posted to the site and will take effect immediately. You should, therefore, read the terms and conditions each time you access this website.

18.2 The material and information contained in this website is not aimed at, or meant to be viewed by, persons other than those in the United Kingdom. Any person who chooses to access this website from other locations is responsible for compliance with applicable local laws.

18.3 There are links on our website to third party websites which we believe may be of interest to you. We do not have any control over the content of these websites nor can we be liable in respect of anything contained on these websites.

18.4 Certain products are subject to age restrictions as indicated on the product page. By placing your order for any of these products, you confirm that you have reached the required age. Your entire order will be cancelled if we are unable able to verify your age using the details you have submitted. Alcohol can only be purchased by and for individuals aged 18 or over.
